RULES OF VISITING
Our esteemed visitors, to ensure a safe and enjoyable experience for all our guests, please remember to: - Mutually respect each other and the employees of the Park - Follow the rules on the use of attractions - Maintain the territory of the Park clear of any garbage - Abide by the regulations of fire safety. IT IS PROHIBITED TO: - Visit the Park under the influence of drugs or alcohol - Bring the alcoholic beverages to the Park’s territory and consume them - Ride a bicycle, skateboard or roller skate on the Park’s territory - Walk your pets over the territory - Visit the Park in the swimsuit or in the dirty clothes that could smudge or stain the attractions. The Administration of the Park is entitled to take relevant measures to remove those individuals from the Park’s territory who are disturbing the public order and refusing to follow the rules of the Kyrlai amusement park. Before using any attraction of the Park, please acquaint yourself with the safety regulations which are located in plain sight in front of every attraction. Every visitor of the Park should acquaint oneself with the information contained in the Rules of Visiting, Rules on the Use of Attractions and the Ticket Policy of the Kyrlai amusement park. TICKET POLICY
Present Ticket Policy here (henceforth referred to as Policy) regulates the procedure for using, purchasing and refunding the payment cards and the unused money on them, therefore it is an integral part of the Rules of Visiting the Kyrlai amusement park. A person who acquires, owns and uses the Payment Card should acquaint oneself with the provisions of the present Policy, as well as respect the Rules of Visiting the Kyrlai amusement park and Rules on the Use of Attractions. The aforementioned information is available on www.kazanpark.ru . 1. The main terms and definitions 1.1. Park – the amusement park located by the following address: The Republic of Tatarstan, Kazan, Odnostoronka Grivky str., 1A 1.2. Payment Card – a laminated plastic card with the Mifare chip (1kb), which allows to pay for riding all functioning attractions of AO Parkinvest equipped with the turnstiles and mobile terminals on the day when aforementioned card was purchased as well as during the whole period of its validity, which is unlimited. The payment is being implemented by writing off the money from the card according to the approved cost of using the attractions. 1.3. Payment Card Owner – a person who owns the card.1.4. Administration of the Park – Parkinvest joint-stock company. 1.6. Ticket Offices – ticket offices and payment terminals located on the territory of the Park (The Republic of Tatarstan, Kazan, Odnostoronka Grivky str., 1A) 1.7. Season – Park’s working period. 1.8. Electromechanical Tripod Waist-high Turnstile (henceforth referred to as Turnstile) – a part of the access control system of the Park intended for controlling the passage areas of the attractions. The turnstiles are designed specifically to secure the closing of the passage area by using three rotating arm stiles. A passage through the turnstile can be opened by the Payment Card or by the employee access card. 1.9. Mobile Terminal for Data Collection (henceforth referred to as Mobile Terminal) – a device designed to grant access to the certain attractions, which cannot be featured with an electromechanical tripod waist-high turnstile, via reading the data from the payment card. 1.10. Force Majeure – extraordinary circumstances which cannot be foreseen or prevented, such as natural disasters (a flood, an earthquake, a fire or rushes of wind from 27 mph), civil strife, explosion, state of war, rebellion, strikes, weather conditions, terrorist attacks and others. 2. Procedure for purchasing and using the payment cards. 2.1. A physical person or legal entity can purchase the Payment Card in the ticket office or via the payment terminals located on the territory of the Park in order to visit the functioning attractions. 2.2. The cost of the Payment Card and visiting functioning attractions equipped with turnstiles or mobile terminals is determined by the specific tariffs approved by Administration of the Park and placed at the information stands in every ticket office of the Park. 2.3. After purchasing and recharging the Payment Card, the visitor would be given a cash voucher. 2.4. The Payment Card Owner is entitled to: - Receive some reliable information about the cost of riding the attractions, the cost of the Payment Card, procedure of using, conditions of purchasing and keeping it, its validity, procedure of checking the balance and refunding either the card or the unused money left on it - Receive some information about the Park working hours - Receive some information about the list of all the functioning attractions featured by the turnstiles or mobile terminals - Receive some clarifications on issues related to visiting the Park from the cashier, attraction operator, manager or the other authorized person of the Park’s Administration - Ride the attractions featured by the turnstiles or mobile terminals in any day of the season during the Park working hours, if there is enough money left on their Payment Card, according to the safety regulations (restrictions on the height, weight and other anthropometric data of the visitors) without any time limits of visiting the Park’s territory in its working hours - Use the public toilet in the Park according to the approved cost of using it - Recharge the balance on the Payment Card in the ticket offices - Refund a purchased price for the Payment Card and the unused money left on it - Pass the Payment Card to other people so they can ride all functioning attractions featured by the turnstiles or mobile terminals - Check the balance on their Payment Card in any ticket office of the Park - Return or replace the Payment Card during the process of purchasing in case of noticing any mechanical damage on the card or the malfunction of the chip inside. 2.5. The Payment Card Owner is obligated to: - Acquaint themselves and comply strictly with the provisions of the present Policy, as well as respect the Rules of Visiting the Kyrlai amusement park and Rules on the Use of Attractions - Maintain the Payment Card in good condition, avoiding any scratches, punctures and any other mechanical damage to the card - Make sure the Payment Card is in the proper condition in the process of purchasing it 2.6. The Payment Card does not apply to riding the attractions owned by different companies other than AO Parkinvest, including the arcade games, slot machines, strength and agility games and also purchasing the goods and services in the outlets located on the Park’s territory. 2.7. Acquiring the Payment Card, the Owner agrees to comply with the rules on use of attractions of the Park and is considered responsible for their violation in accordance with the present Policy and current legislation of the Russian Federation. 3. The admission to the Park’s territory 3.1. The admission is unlimited and free of charge. 3.2. The Administration of the Park is entitled to take relevant measures to remove those individuals from the Park’s territory who are disturbing the public order and refusing to follow the rules of the Kyrlai amusement park. 4. The admission to the attractions 4.1. In order to gain the admission to the functioning attractions of the Park the visitor should: - Acquire the Payment Card in one of the Park’s ticket offices according to the approved cost of the card - Pass a sufficient amount of money (with cash or via Visa/MasterCard payment system) to the account of the Payment Card to pay for using the attractions. 4.2. In order to pass to the attraction the Payment Card Owner should bring the card to the special data-reader on the turnstile or use the mobile terminal. If the card has enough money on it to pay for the ride, the turnstile indication would turn green and the passage would be open. The money on the Payment Card account shall be written-off in the following cases: - When the card Owner passes through the turnstile by dropping its arm in order to ride the attraction - When the card Owner uses the mobile terminal and presses the button “pass” in order to ride the attraction (if there is enough money left on the Payment Card according to the approved cost of using it) 4.3. The procedure of admission for the attractions owned by other companies should be specified directly in the moment of entering the attraction. 5. Responsibility of the Administration and the Payment Card Owners 5.1. Visiting the Park and its attractions means that the Payment Card Owner is fully aware of and accepts the risks involved, therefore is considered responsible for their own safety as well as for the safety of any children under their supervising. 5.2. The Park is not held liable to the Payment Card Owner in relation to the attractions of the Park, in case if the reasons why the Owner cannot ride the attractions are not related to any actions of the Park, such as the loss of the Payment Card, any damage caused to the Payment Card, card forgery committed with or without the Owner’s consent in order to use the attractions, and others. 5.3. Administration of the Park is entitled to control, plan, restrict and deny the admission to the certain areas and attractions of the Park, if needed. It is possible for the certain areas and establishments of the Park, as well as for the Park itself, to be closed completely due to the technical reasons or the force majeure for security purposes, if there are any dangerous weather conditions or some repair work is being carried out. 5.4. Administration of the Park is not held liable in relation to not committing certain obligations according to the present Policy in cases of force majeure. 5.5. With the exceptions of cases determined by legislation of the Russian Federation, the Administration of the Park shall be liable to the Payment Card Owner only for the amount of the value of the card and use of attractions. 5.6. The Administration of the Park is not held liable to the Payment Card Owner if the card was lost, stolen or damaged, and also in case of acquiring the forgery of the Payment Card outside the Park, therefore the value of the card will not be compensated. 6. Final Clauses 6.1. All the requests for further information about the Payment Cards and cost of visiting the attractions should be sent through the feedback form of the Website. 6.2. Information about the cost of riding the attractions and purchasing the Payment Card can be found on specific information stands nearby every ticket office of the Park. It can also be found on the Website. 6.3. Copies of the present Policy are available for visitors in every ticket office of the Park. 6.4. The Park is entitled to unilaterally make changes to the present Policy, if needed; these amendments shall enter into force from the day the updated version of the Policy was posted on the Website (www.kazanpark.ru). 6.5. The provisions of present Policy are made in accordance with the law of the Russian Federation. Any dispute coming from the legal relationship based on the present Policy should be resolved in claim procedure; the review period for the claims shall be 10 (ten) days from the moment when the claim was received. 6.6. In case if any clause of the present Policy would be declared unlawful or unfeasible, all the other clauses of the present Policy will remain in force regardless. The unlawful or unfeasible element of the Policy should be committed as much as possible, regarding to the feasible and lawful part of it, for the intentions of the Parties to be fulfilled completely.
